Terms of Service
Last updated: February 10, 2025. We may update these terms from time to time and will post the new version here with an updated date. Continued use of the service after changes constitutes acceptance.
1. Acceptance of terms
By accessing or using How We Win ("the service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the service. If you are using the service on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.
2. Use of the service
How We Win provides planning, goal-tracking, and team coordination tools. You may use the service for personal and team use in accordance with these terms. You are responsible for your account, the content you create, and for ensuring that your use complies with applicable laws.
3. Acceptable use
You agree not to use the service to: (a) violate any law or regulation; (b) infringe the rights of others; (c) distribute malware, spam, or harmful content; (d) attempt to gain unauthorised access to the service, other accounts, or our systems; (e) resell or sublicense the service without our consent; or (f) use the service in a way that could harm, overload, or impair it. We may suspend or terminate access if we reasonably believe you have breached this section.
4. Accounts
You must provide accurate information when registering and keep it up to date. You are responsible for keeping your credentials secure and for all activity under your account. One account per person. You must be at least 13 years old to use the service; in some jurisdictions a higher age or parental consent may apply as set out in our Privacy Policy.
5. Your content and our licence
You keep ownership of the content you create (goals, tasks, notes, etc.). By using the service, you grant us a limited licence to host, store, process, and display that content as necessary to provide and improve the service. We do not claim ownership of your content or use it for marketing or other purposes beyond operating the service, as described in our Privacy Policy.
6. Termination
You may stop using the service at any time and may delete your account through the app or by contacting us. We may suspend or terminate your access if you breach these terms or for other serious reasons (e.g. non-payment, abuse). When your account is closed, we will delete or anonymise your personal data within 90 days in accordance with our Privacy Policy, except where we must retain it for legal or safety reasons. You may export your data before closing your account where the service provides that option.
7. Disclaimers
The service is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, or free of harmful components. We disclaim all warranties to the fullest extent permitted by law. Any reliance on the service is at your own risk.
8. Limitation of liability
To the fullest extent permitted by law, How We Win and its providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of data, profits, or business) arising from your use of or inability to use the service. Our total liability for any claims arising from or related to the service shall not exceed the amount you paid us in the twelve months before the claim arose, or, if you have not paid us, fifty euros (€50). Some jurisdictions do not allow certain limitations; in such cases our liability is limited to the maximum permitted by law.
9. Indemnity
You agree to indemnify and hold harmless How We Win and its affiliates, officers, and agents from any claims, damages, losses, or costs (including reasonable legal fees) arising from your use of the service, your content, or your breach of these terms.
10. Governing law and jurisdiction
These terms are governed by the laws of Spain. Any dispute arising from or relating to these terms or the service shall be subject to the exclusive jurisdiction of the courts of Spain.
11. Changes to these terms
We may change these terms from time to time. We will post the updated terms on this page with a new "Last updated" date. If a change is material, we may notify you by email or through the service. Continued use of the service after the change constitutes acceptance. If you do not agree, you should stop using the service and may close your account.
